Article 1: General Provisions: 

The e-commerce website beautyaswell.com under company Comptoir Adam B.V. a private limited company, with registered office at Carnotstraat 127, 2060 Antwerp, VAT BE 0733.826.972, offers its customers the opportunity to purchase the products from its web store online.

These General Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order through beautyaswell.com's online store, the Customer must expressly accept these Terms, thereby agreeing to the applicability of these Terms to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by beautyaswell.com.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The prices listed on the website for the goods offered at the time of ordering are applicable. beautyaswell.com reserves the right to change the prices of the goods, in particular if a legal price-determining factor gives rise to this.

The statement of price refers exclusively to the articles as it is described verbatim. The accompanying photographs are for decorative purposes and may contain elements not included in the price.

Article 4: Online Purchases

All offers, orders and agreements are subject to the provisions of these General Terms and Conditions of Sale, unless beautyaswell.com expressly deviates from them in its offers.

By ordering, you accept the applicability of the then current Terms and Conditions of Sale.

Offers

All offers of beautyaswell.com are without obligation and may be revoked. The term of all offers is: while supplies last, or the term as stated on the website. After exceeding the duration of an offer, you can no longer use the corresponding offer.

Orders

You can order in the manner described on the website. beautyaswell.com does not accept orders if beautyaswell.com cannot establish the address details provided as correct. beautyaswell.com is also entitled to refuse orders on other grounds or to attach special conditions to the agreement. If an order is not accepted, or if beautyaswell.com wishes to attach special conditions to the agreement, beautyaswell.com will notify this within 5 calendar days after receipt of the order.

An agreement is not concluded until beautyaswell.com has confirmed your order by e-mail.

beautyaswell.com is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.

Article 5: Delivery and implementation of the agreement

Items ordered via this web shop are delivered throughout Europe.

For orders over 40.00 EUR delivered in Belgium, The Netherlands and Germany, beautyaswell.com does not charge for delivery costs. For orders up to 40,00 EUR delivered in Belgium, The Netherlands and Germany, beautyaswell.com charges 6.95 EUR for delivery costs.For France, the delivery costs are 9.95 EUR.

Unless otherwise agreed or expressly stipulated, goods are delivered to the customer's residence within 1- 7 working days after receipt of the order.

Any visible damage and/or qualitative deficiency of an item or other shortcoming in the delivery must be reported by the Customer to beautyaswell.com without delay. within 2 working days.

The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer on delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by beautyaswell.com.

Article 6: Retention of title.

The delivered items remain the exclusive property of beautyaswell.com until full payment by the Customer.

The Customer undertakes to draw the attention of third parties to beautyaswell.com's retention of title if necessary, e.g. to any person who would come to seize the not yet fully paid for articles.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase items online from beautyaswell.com in their capacity as consumers.

The Customer has the right to revoke the contract within a period of 14 calendar days without giving reasons.

The withdrawal period expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good.

To exercise the right of withdrawal, the Customer must inform beautyaswell.com, Carnotstraat 127, 2060 Antwerp, email info@beautyaswell.com of its decision to withdraw from the contract by an unequivocal statement (e.g. in writing by post or email). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to beautyaswell.com, Carnotstraat 127, 2060 Antwerp, without delay, but in any event no later than 14 calendar days after the day on which he communicates his decision to withdraw to beautyaswell.com. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

If the returned product is somehow diminished in value, beautyaswell.com reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only items that are in their original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the Customer revokes the contract, beautyaswell.com will refund all payments received from the Customer up to that point, including standard delivery costs, to the Customer within a maximum of 14 calendar days after beautyaswell.com is informed of the Customer's decision to revoke the contract. For sales contracts, beautyaswell.com may wait to refund until it has received all the goods back, or until the Customer has proved that it has returned the goods, whichever comes first

Any additional costs resulting from the Customer's choice of a mode of delivery other than the least expensive standard delivery offered by beautyaswell.com shall not be refunded.

beautyaswell.com will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refund.

Article 8: Warranty

Pursuant to the Act of September 21, 2004 on the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods.

Some warranties are imposed by the manufacturer. This applies to:

  • 1 year for Babyliss Pro
  • 1 year for WAHL and all other brands.

For items purchased online and delivered to the Customer's home, the Customer must contact info@beautyaswell.com and return the item to beautyaswell.com at their expense.

If a defect is detected, the Customer must inform beautyaswell.com as soon as possible. In any case, any defect must be reported by the Customer within a period of 14 days after its detection. Thereafter, any right to repair or replacement expires.

The warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the item contrary to purpose for which it was designed, failure to comply with the instructions for use or manual, modifications or alterations to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use.

The customer himself is responsible for keeping his login data and password confidential. Your password is stored encrypted, so beautyaswell.com has no access to your password.

Article 12: Invalidity - non-violation

If any provision of these Terms is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions.

Failure at any time by beautyaswell.com. to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.

Article 13: Modification of conditions

If one or more of the provisions of these Terms and Conditions or any other agreement with beautyaswell.com should be in conflict with any applicable legal provision, the provision in question will cease to apply and will be replaced by a new legally permissible similar provision to be determined by beautyaswell.com.

beautyaswell.com reserves the right to amend these Terms and Conditions.

On the agreement will apply those Terms and Conditions that were published on the website at the time of the conclusion of the agreement. You can print these before or during the ordering process on the website.

Article 14: Applicable law - Disputes

Belgian law applies, with the exception of the provisions of international private law on applicable law.

The courts of the Consumer's place of residence have jurisdiction in the event of legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
